AGREEMENT TO TERMS

These Terms of Service ("Terms") are a legally binding agreement between you ("you" or "user"), whether personally or on behalf of an organization, and Pacebeats ("Company," "we," "our," or "us"), governing your access to and use of the Pacebeats mobile application and any related platforms, services, or tools (collectively, the "Service").

By downloading, accessing, or using our Service, you agree to be bound by these Terms. If you do not agree, you must immediately stop using the Service and uninstall the application.

We may update these Terms at any time, and the updated version will be indicated by a "Last Updated" date. Your continued use of the Service after changes are posted constitutes acceptance of those changes.

1. Acceptance of Terms

By accessing and using Pacebeats, you accept and agree to be bound by the terms and provisions of this agreement. This includes all policies, guidelines, and rules referenced herein. Your continued use of the service constitutes acceptance of any modifications to these terms. If you do not agree to these terms, please do not use our service.

2. Use License and Restrictions

Permission is granted to use Pacebeats for personal, non-commercial fitness and running purposes only. This license does not include modifying or copying our materials, using the materials for commercial purposes, attempting to reverse engineer any software contained in Pacebeats, removing any copyright or proprietary notations, or transferring the materials to another person or mirroring the materials on any other server. This license shall automatically terminate if you violate any of these restrictions.

3. User Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. This includes creating a strong password and keeping it secure, not sharing your account credentials with others, promptly notifying us of any unauthorized access or security breaches, ensuring your account information remains accurate and up-to-date, and understanding that you are responsible for any content posted or actions taken through your account.

4. Data Privacy and Protection

Pacebeats is committed to protecting your personal information while providing the best possible fitness tracking experience. Our data protection practices include:

  • Secure encryption of all personal data and fitness metrics
  • Limited data collection only for app functionality improvement
  • No sharing of personal information with third parties without consent
  • User control over data sharing and deletion
  • Compliance with applicable data protection regulations

5. Health and Safety Disclaimer

IMPORTANT: Pacebeats is a fitness tracking application and should not be used as a substitute for professional medical advice, diagnosis, or treatment. By using this app:

  • You acknowledge that you are physically capable of participating in running activities
  • You understand the risks associated with physical exercise and running
  • You agree to consult with a healthcare professional before beginning any new fitness routine
  • You will not hold Pacebeats liable for any injuries or health issues that may occur
  • You will use the app responsibly and within your physical limitations

6. Music and Content Usage

Pacebeats integrates with music streaming services to provide tempo-matched playlists. Users are responsible for having valid subscriptions to any third-party music services. We do not store or distribute copyrighted music content. All music is streamed through legitimate platforms in accordance with their respective terms of service.

7. Limitation of Liability

Pacebeats is provided "as is" and "as available." We make no warranties about the accuracy of fitness data, continuous service availability, or results from using the app. We are not liable for any damages resulting from your use of the app, including but not limited to lost data, fitness injuries, or any other direct or indirect damages.

8. Termination

We reserve the right to suspend or terminate your access to Pacebeats at any time, without notice, for conduct that violates these Terms or is otherwise harmful to our service or other users. You may also terminate your account at any time by deleting the application and contacting us to remove your data.

9. Governing Law

These Terms are governed by applicable local and international laws. Any disputes will be resolved through appropriate legal channels in accordance with the jurisdiction where Pacebeats operates.
